General Terms and Conditions (GTC) for Simulabs

1. Scope
These General Terms and Conditions (GTC) govern the use of the digital learning platform SimuLabs (hereinafter referred to as the “Platform”) by schools, teachers, students, and other users. The platform is operated by Aymelek e.U. (sole proprietorship), Lichtensteiner Weg 3, 71229 Leonberg, Germany. Additional contact details can be found in our Legal Notice.

2. Services Provided by Simulabs
Simulabs offers a digital platform for interactive science experiments. Use of the platform is available through both free and paid plans. The exact scope of services is defined in the respective product description.

3. Registration and Conclusion of Contract
(1) Use of the platform requires registration. If users under the age of 16 access the platform, it is assumed that parental or school consent has been granted.
(2) By registering and using the platform, the user accepts these GTC.
(3) For paid services, a contract is formed upon confirmation of the order and receipt of payment.

4. Prices, Payment Terms, and Right of Withdrawal
(1) Prices for paid services are clearly displayed on the platform.
(2) Payment is made via the available payment methods.
(3) In the event of delayed payment, access to paid content may be restricted.
(4) Consumers have a 14-day right of withdrawal when signing up for a paid subscription. This right expires once digital content has been provided at the user’s explicit request. Full details can be found in our Withdrawal Policy.

5. Usage Rights and Copyright
(1) Users are granted a non-exclusive, non-transferable right to use the platform for the duration of the contract.
(2) The platform’s content (texts, videos, software, etc.) is protected by copyright. Redistribution, public display, reproduction, or commercial use is not permitted.

6. User Obligations
(1) Users may only use the platform in accordance with applicable laws and school regulations.
(2) Access credentials must not be shared with third parties.
(3) Misuse (e.g., hacking, tampering) will result in account suspension.

7. Data Protection and Cookies
Personal data is processed in accordance with our Privacy Policy. Data is used exclusively for operating the platform and is not shared with third parties unless required by law. This platform uses only technically necessary cookies, primarily for secure authentication and session handling via AWS Cognito. No cookies are used for analytics, marketing, or third-party tracking. As only essential cookies are in use, no cookie consent banner is required under §25(2) TTDSG.

7a Accuracy of Content and Simulation Results
The content provided on the platform, particularly simulation results and experiment/course data, is intended for educational purposes only. While every effort has been made to ensure accuracy, Simulabs makes no guarantees regarding the absolute correctness, completeness, or reproducibility of content. It is not a substitute for expert scientific advice or physical laboratory experiments.

8. Availability and Liability
(1) Simulabs strives to ensure high availability of the platform but cannot guarantee uninterrupted service.
(2) Simulabs is not liable for technical disruptions or data loss unless caused by intentional or grossly negligent behavior.

9. Term and Termination
(1) Free services may be canceled at any time.
(2) Paid subscriptions run for the agreed term and can be terminated with one month’s notice before the end of the term.
(3) Extraordinary termination for good cause remains unaffected.

10. Changes to the GTC
Simulabs reserves the right to update these GTC. Changes will be announced at least 30 days in advance on the platform. Users may object to the changes. In that case, the user agreement will be terminated, unless legally specified otherwise. If explicit consent is required, it will be actively requested.

11. Final Provisions
(1) The law of the Federal Republic of Germany applies, unless mandatory consumer protection laws in the user’s country of residence provide otherwise.
For business customers, the place of jurisdiction is Leonberg, Germany.
(2) The place of jurisdiction, where legally permissible, is Leonberg. Mandatory legal provisions regarding other jurisdictions remain unaffected.
(3) If any provision of these GTC is found to be invalid, the remaining provisions shall remain in full force and effect.
